Laura Brancato

Laura M. Brancato is a litigator who devotes her practice to complex elder law litigation including Article 81 and 17A guardianship proceedings, Article 9 proceedings under the Mental Hygiene Law, power of attorney litigation and Medicaid administrative appeals. As lead attorney in the litigation department, Ms. Brancato also handles surrogate’s court litigation including contested wills, turnover proceedings, judicial accountings, and related ligation.

Ms. Brancato also works with estate planning clients on the preparation and execution of estate planning documents, trust agreements and Medicaid asset protection plans. She has extensive experience litigating in New York State Supreme Court, Surrogate’s Court and at all level of administrative hearings on behalf of her clients. Prior to working in Elder Law, Ms. Brancato held a position as an Assistant District Attorney where she tried cases in the Gang/Major Case Unit of the office.

As a compliment to her litigation practice, Laura serves as Vice Chair of the Guardianship Committee of the Elder Law Section of the New York State Bar Association (NYSBA) and committee member of the New York City Bar Association, and Westchester Women’s Bar Association. She co-authors the NYSBA Practical Series manual on elder law and special needs planning and is a regular contributor to the Littman Krooks webinar series.

Laura received her undergraduate degree from Loyola University in Maryland where she studied political science and business. Ms. Brancato received her JD from St. John’s University School of Law where she held an executive board position on the Moot Court Honor Society and conducted pre-trial hearings in State Supreme Court as a law student through the prosecutor’s clinic.
